Terms of guarantee

We offer a 20-year guarantee

The following conditions apply to all services, including future deliveries, with exclusion of the customer's general business terms and conditions. Individual agreements which differ from these term require our explicit written confirmation and, in case of doubt, apply only to the specific legal transaction for which they were explicitly agreed in writing.

1. Duration and beginning of the guarantee:

a) The guarantee for Biohort products is granted for a period of 20 years.
b) The period of guarantee begins on the invoice date. Replacement deliveries do not lead to an extension of the original guarantee period.

2. Terms and conditions for the guarantee:

a) The Biohort product was purchased from a Biohort distribution partner.
b) The assembly/construction was carried out competently and in accordance with the accompanying assembly manual.
c) The Biohort product was used for the storage of garden tools, garden furniture and bicycles, etc. and not for purposes other than that for which it was intended.
d) The Biohort product is in the possession of the original purchaser and has not been dismantled and rebuilt. The invoice must be presented as proof of guarantee.

3. Content and scope of the guarantee:

a) The guarantee covers rusted through sheet metal and parts that are unusable or the use of which is severely impacted due to faulty design or poor workmanship. These parts will be repaired or replaced at our discretion without further cost to the customer.
b) We are not liable for any costs incurred for the removal, installation and transport. The defective parts become either our property or must be disposed of by the customer.
c) We do not assume liability for any consequential damages.

4. Limitations of the guarantee:

a) This guarantee does not cover defects which have occurred due to:

  • Transport damages (the shipping company is liable for these damages - please report them immediately)
  • External influences or unforeseen forces, natural phenomena (e.g. hail)
  • General assembly errors
  • Damages due to faulty foundations, inadequate water drainage in the area of the ground profile
  • Unsuitable choice of location and/or missing or inappropriate anchorage
  • Paint damages and scratches, which were not repaired immediately
  • Maintenance errors (e.g. failure to lubricate the cylinder lock and hinges)
  • Excessive ambient humidity or aggressive environmental conditions (e.g. aggressive and abrasive cleaners, de-icing salt, fertilisers and other chemical materials, salty and/or sandy air. Locations within 300 m of the coast are, in any case, excluded from the guarantee)
  • Justifiable wear and tear (e.g. cylinder locking mechanism)
  • Colour changes - the pigments used will alter as a result of long-term effects of light and weather

For glass/luminous elements (incl. those in doors and windows), electrical, rubber and plastic parts (e.g. the EPDM roof membrane), only the statutory 24-month warranty period applies.

b) This guarantee expires if the customer is in payment arrears or if the defect is not reported in writing immediately upon discovery and proof of damage submitted with the claim.

5. Miscellaneous:

The place of performance for all obligations arising as a result of guarantee claims is 4120 Neufelden, Austria.
