The protection of your personal data is a primary concern for us. We therefore process your data solely on the basis of the EU General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG), as amended on 25 May 2018. This data protection declaration is intended to inform you of the nature, scope and purpose of collecting and processing your data. We, Biohort GmbH - hereinafter referred to as "Biohort", are responsible for data processing in data protection terms. The collection and processing of your data

We collect and process your personal data when you place an order, subscribe to our newsletter, send in a job application or visit our website. The nature, scope and purpose of data processing are described below.

Order 

We need the following customer information to enable you to place an order in the shop and for us to process your order: first name, last name, email address, street, postcode, town, country and telephone number. We need your email address and telephone number to contact you quickly if there are any queries or information in relation to your order. In addition, in the case of credit card payments, we need to know the type of credit card being used, your credit card number, the credit card expiry date and the security number on the back of your credit card. We do not collect any data when customers pay by credit card as credit card payments are processed by our payment partner, Unzer (www.unzer.com). Your data will always be transmitted in an encrypted format via the Internet using SSL technology (at least 128 bits). For the "purchase on account" and "Direct Debit" payment methods, your date of birth must also be entered. 

Risk assessment & credit check

Biohort does not carry out the risk assessment and credit check itself. Credit card payments are processed by our payment partner, Unzer (www.unzer.com). "Payment on account" and "Direct Debit" payment methods are processed by our payment partner, Unzer. Specific data used for the credit check are not passed on to Biohort.

Application data

You can submit an application to Biohort via our website. The data submitted is only used in-house for recruitment purposes and is not forwarded to third parties. You can ask for this data to be deleted at any time.

Newsletter and email advertisement

If you sign up for our newsletter and, in doing so, give us your consent, we will process your name and email address in order to send you our newsletter. Your personal data will be stored until you unsubscribe from the newsletter or withdraw your consent. However, this information will not be forwarded to third parties.

You can withdraw your consent or unsubscribe from the newsletter at any time by sending an email to the following address ecommerce@biohort.at or by clicking on the unsubscribe link at the end of each newsletter or informing us using a different method. Similarly, you are giving us express permission to send you useful information about the respective purchase via email once you have clearly demonstrated you intention to purchase the product in question (e.g. by adding it to the basket).

Website visit/use of cookies

When you visit our website, we collect as much personal data that is technically required (name of the file accessed, date and time of login, volume of data transferred, notification of successful login, browser type including version, the user operating system, referrer URL and the requesting provider). We cannot assign this data to specific individuals. Furthermore this data is not combined with data from other data sources.

We wish to point out that cookies are used when visiting our website. Cookies are small files or other types of stored information transmitted from our web server or third-party web servers to the user's web browser where they are stored for subsequent retrieval. The cookies used when visiting our website serve merely to simplify the purchasing process (e.g. by storing the items added to a shopping basket) and enable certain functions of our online shop to be utilised. The cookies employed by us are deleted from your hard drive at the end of the browser session (session cookies). This data is collected on the basis of Article 96 (3) of the Austrian Telecommunications Act (TKG).

We also use cookies to carry out the statistical analysis of our website traffic as part of the Google Analytics web analysis service (see below). This data is collected on the basis of Art 6 (1) f of the GDPR. If you have already consented to this in accordance with Art 6 (1) a of the GDPR, cookies from third-party providers will be used when you visit our website in order to collect and assess your usage behaviour. In using our website, you are consenting to the use of cookies. Visitors are informed of the use of cookies in a banner, which is displayed when they visit the website for the first time. 

Use and transmission of your data

The data you provide is used exclusively to process your order and fulfil the terms of the contract between you and us. Data processing is carried out on the legal basis of Art 6 (1) b of the GDPR. Once the entire contract has been processed and the purchase price paid in full, your data will be archived and deleted on expiry of the retention periods under tax and commercial law or the periods stipulated in the Austrian Product Liability Act (PHG) unless you have consented to the subsequent use of your data.

Your personal data will only be forwarded to third parties or otherwise disclosed if this is required in order to process the contract or for billing purposes or if you have given your consent in advance. In the order processing context, for instance, the service providers commissioned by us (e.g. shipping and logistics companies, payment service providers) receive the data required for order processing purposes. However, we are legally obliged to make the respective data available to the authorities in the event of a legal requirement, official order or an official investigation.

Data security

Your contract data is transmitted in an encrypted format via the Internet using SSL technology. We use technical and organisational measures to secure our website and other systems against loss, destruction, access, data modification or data distribution by unauthorised individuals.

Geo-localisation

We use geo-localisation to facilitate your search for a Biohort dealer in your area via our website. We then have the technical means to determine the location of the Internet user via the IP address.

We also use geo-localisation to display the right products, prices and taxes for your respective country in our online shop.

Google Analytics

We use Google Analytics, a web analysis service of Google Ireland Limited ("Google"), Barrow Street, Dublin 4, Ireland. Cookies are placed on your computer as part of the "Google Analytics" set-up in a bid to conduct a statistical evaluation of how you use our website. We have concluded a corresponding contract with Google to process order data. The information generated by these cookies regarding your use of this website (including your IP address) is anonymised before being stored on the Google servers so that it can no longer be assigned to a specific computer. The full IP address is forwarded only in exceptional cases to a Google server in the USA where it is abridged. Google uses this information to assess your use of the website in order to compile website activity reports for website operators and to provide other website and Internet usage-related services. The IP address transmitted by your browser in the Google Analytics setting is not merged with other Google data. It should, however, be noted that some of the website functions may not be fully functional once this step has been taken.

Google Remarketing

This website uses the Google program for interest-based advertising known as Google Remarketing. Third party vendors, including Google, display ads on websites across the Internet and use stored cookies based on your previous visits to our website. You can disable Google's use of cookies for these purposes by visiting the Disable Google Advertising page via the following link: http://www.google.com/policies/technologies/ads/. Alternatively, you can disable the use of cookies by third-party vendors by visiting the Disable Network Advertising Initiative page via the following link: http://www.networkadvertising.org/choices/. By using our website, you are giving your consent to the processing of your personal data collected by Google, as described, for the purposes set out above. Google Maps

We sometimes include Google Maps produced by Google Ireland Limited, Barrow Street, Dublin 4, Ireland - a service for displaying interactive maps - on our websites. This enables us to show you the location of our trading partners. We also use Google Maps to show you our company location. When you access the Google Map web pages, some information, particularly your IP address, the browser software you are using and its settings, are collected by Google, transmitted to the USA and stored. Google is solely responsible for collecting and storing this data and for evaluating the latter for its own purposes. Google LLC is certified for the US-European data protection agreement, "Privacy Shield", which ensures compliance with the level of data protection applicable in the EU. Google Ads Conversion Tracking

We use the "Google Ads" service for our online product range and, more precisely, "Google Conversion Tracking" produced by Google Ireland Limited, Barrow Street, Dublin 4, Ireland, ("Google"). "Google Conversion Tracking" is used to set a cookie for conversion tracking when you click on an ad. If you select certain pages of our online product range, both Google and Biohort will recognise from the aforementioned cookie that you have clicked on a corresponding advertisement and have been redirected to our online product range. If you do not wish to participate in Google conversion tracking, you can opt out simply by disabling the corresponding Google conversion tracking cookie via your internet browser. In this case, the conversion tracking statistics will not be recorded. Use of social media plug-ins

We use plug-ins from YouTube, www.youtube.com, and Facebook, www.facebook.com, which are operated by YouTube, Google Ireland Limited, Barrow Street, Dublin 4, Ireland and Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, respectively. For this purpose, we use a two-stage procedure in which you can consent to the processing of data by the social network operator in accordance with Art 6 (1) a GDPR. Data is only transmitted to the social network operator when users click on one of the icons displayed and thus consent to the transmission of data to the said social network operator. Your browser will only connect to the respective social network once consent has been given.

The social networks find out about your visit to our websites via the plug-in. If you are logged into YouTube or Facebook, your visit can be logged to your social network account. Any interactions with the plug-in can be stored by the network operator. Information on the use of the data collected by the respective social network can be found on the

Tools and apps used

Roomle 3D configuration service: We provide our users with access to a 3D configurator in order to enhance the product experience. This service is provided by Roomle GmbH, Peter-Behrens-Platz 2, 4020 Linz. Roomle has exclusive access to the configuration data generated by users in any given session, but cannot access any personal data or any other user data relating to visitors to our website. Roomle uses Google Analytics, a web analysis service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. 

This service uses so-called "cookies" (see above).The information generated by cookies about your use of this website is generally transmitted to and stored on a Google server. On Roomle's behalf, Google uses this information to assess your use of the Roomle Configurator, to compile reports about activities with the Configurator and to provide other services to Roomle related to the use of the Configurator. The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data. The storage of cookies required by Google Analytics can be prevented by a relevant setting in your browser software. However, as a result, you may not be able to use all of the Rubens Configurator functions to their full extent. You can prevent collection of the data generated by the cookie and related to your use of the configurator (incl. your IP address) as well as data transmission and processing by Google by downloading and installing the browser plug-in available via the following link: tools.google.com/dlpage/gaoptout.

Rights as a Data Subject

You have the right to receive information about your personal data and to exercise rectification or erasure or restriction of processing rights. Data subjects can also object to data processing and are entitled to have their personal data transferred in a structured, machine-readable form. Right of appeal
